Terms of Service

These Terms of Service ("Terms") govern the provision of flood restoration services by Local Carpet Cleaning Pty Ltd (ABN 15 682 871 192), trading as Floodrest ("Floodrest", "we", "us", or "our"), to you, the customer ("you" or "Client"). By engaging our services, including through submission of our onboarding form, you agree to be bound by these Terms.
1. Scope of Services
Floodrest provides flood restoration services, including water extraction, drying of structures and contents, cleaning, and flood damage mitigation ("Services"). We are not builders and do not perform construction, structural repairs, or alterations. The specific scope of work will be outlined in a written quote, work order, or agreement provided to you before commencement.
2. Payment Obligations
Responsibility for Payment: You are solely responsible for payment of all invoices for Services rendered by Floodrest, as per the terms outlined in the quote, work order, or invoice.
Payment Terms: Unless otherwise agreed in writing, payment is due within 7 days of invoice issuance. We may require a deposit or progress payments for larger projects, as specified in the quote or agreement.
Late Payments: Overdue payments may incur interest at a rate of 5% per annum above the Reserve Bank of Australia’s cash rate, calculated daily, and reasonable debt recovery costs, as permitted by law.
No Contingency on Insurance: Payment for Services is not contingent on approval or payout from your insurance provider. You acknowledge that Floodrest is not responsible for delays or non-payment by your insurer.
3. Insurance Claims
Your Responsibility: You are solely responsible for filing and managing any insurance claims related to flood damage and for seeking reimbursement from your insurer.
Insurance Information: Any insurance policy details (e.g., policy number) provided to Floodrest via the onboarding form or otherwise are for reference only and do not alter your payment obligations.
No Representation: Floodrest does not submit insurance claims on your behalf, provide insurance advice, or guarantee coverage under your policy.
4. Client Obligations
Access: You must provide Floodrest with reasonable access to the property to perform the Services, including necessary permissions and safe working conditions.
Information: You must provide accurate and complete information about the property and flood damage through the onboarding form or as requested.
Compliance: You agree to comply with all reasonable directions from Floodrest to facilitate the Services, including moving contents or ensuring the site is accessible.
5. Warranties and Liability
Service Guarantee: Floodrest warrants that Services will be performed with due care and skill, in accordance with industry standards for flood restoration, and within a reasonable time, as required by the Australian Consumer Law.
Limitation of Liability: To the extent permitted by law, Floodrest’s liability is limited to the cost of re-performing defective Services or remedying damage directly caused by our negligence. We are not liable for indirect or consequential losses, such as loss of use, profits, or additional damage from unmitigated flood effects.
Australian Consumer Law: Nothing in these Terms excludes or limits your non-excludable rights under the Australian Consumer Law, including guarantees that services be provided with due care and skill and fit for purpose.
6. Termination
By Client: You may terminate the Services by providing written notice, subject to payment for all work completed and costs incurred up to the termination date, as permitted by law.
By Floodrest: We may terminate the Services if you fail to make payment within 14 days of a due invoice, breach these Terms, or fail to provide necessary access or information, subject to reasonable notice and opportunity to remedy.
Refunds: Deposits or payments for work already performed are non-refundable unless required by law.
7. Force Majeure
Floodrest is not liable for delays or failure to perform Services due to events beyond our reasonable control, such as natural disasters, government restrictions, or supply chain disruptions. We will notify you promptly and work to resume Services as soon as practicable.
8. Privacy
Floodrest collects personal information (e.g., contact details, insurance policy numbers) via the onboarding form to provide the Services. We handle your information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). Contact us at [insert contact details] to access or correct your information.
9. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
10. Amendments
Floodrest may update these Terms from time to time. The version in effect at the time you engage our Services applies. Updated Terms will be available on our website or provided upon request.
